The US Court of Appeals has dismissed Angela Ebner’s lawsuit againstr Fresh Inc.

It’s quite bewildering and sometimes disheartening to hear that even a little than like a lip balm can make the object of a full-fledged lawsuit. Earlier this month, a woman from the United States sued a lip balm manufacturer because she believed that one of their products violated the consumer laws.

Before heading into any details, let’s take a moment and answer one simple question. What do you when the lip balm stick runs dry, but there’s still a bit stuck on the bottom? Well, we usually use our digits in order to scrape out the very last drop, although the action is hardly worth the effort in the first place.

Now, as baffling as it may seem, a woman from the United States actually sued a renowned lip balm company for a trifle. The woman, by the name of Angela Ebner, filed a lawsuit against Fresh Inc., a cosmetic manufacturer, on the account that the quantity inscribed on one of their products misleads the consumer.

More specifically, Misses Ebner complained about one of their beauty products entitled Sugar Lip Treatment. According to the case file, Ebner declared that the lip balm’s package misleads users about the products quantity.

The Sugar Lip Treatment, which costs around 24 dollars, comes with a twist-up mechanism that allows the tube to dispense up to 75 more balm than the tube original opening. Angela Ebner declared in front of the court that the mechanism did not work and that she believes that her rights as a consumer are being violated by the cosmetic product’s packaging.

Furthermore, it would seem that this is not the first time Angela turn towards the law in order to quench her thirst for blindly-delivered justice. According to some court document, it would seem that this is the 9th time in row Angela Ebner appeared before the US Court of Appeals.

Fortunately, the magistrates ruled for the cosmetics manufacturer. In their closing remarks, the judges told Misses Ebner that the product’s label mentions quite clearly just how much balm can be found in the product.

Moreover, the court ended its ruling by telling Ebner that she should take a couple of lessons in how to handle a lip tube. They’ve also stated that the decision of using the twist mechanism rests solely on the user of the product.

If the user thinks that he or she wants to extract the remaining products, he or she can either use a small tool, fingers or the mechanism provided by the company.
